MEMBERSHIP AGREEMENT

Between Kirkland Sailing Club, and its Clubs and Affiliates and its Members

Member shall have the right to use all facilities and boats of the Club subject to the Membership Guidelines as established by the Club. 

Authorized use of Kirkland Sailing Club vessels and equipment requires adherence to the Operator Terms & Conditions.

Club will endeavor to provide a number and variety of boats sufficient to satisfy all members.

Members recognize that due to membership demand, repairs, maintenance and other factors beyond control of the Club, boats may not be available at those specific times desired by Member and Member agrees that Club shall not be liable for any claim because of the unavailability of boats.

This membership does not confer ownership right or any interest in Club assets.

This membership is specific to Member but is transferable in accordance with the current Guidelines.

FEES & DUES.

Club acknowledges receipt from Member of an initiation fee, which is fully earned upon receipt and is non-refundable.

Member agrees to pay monthly dues. Dues are payable on the first of each month and are delinquent on the tenth of the month. If Member is delinquent in payment of monthly dues or other account charges, Member’s right to the use of Club facilities and boats shall be suspended until all account charges have been paid.

CONTRACTUAL OBLIGATIONS.

The minimum Term of this Contract is twelve months from the start date.

Contractual dues may be subject to change upon thirty (30) days’ written notice to Member and are effective only after the end of the contract term. Member must give written notice of resignation at least thirty (30) days prior to the end of their contract term. Failure to do so leaves the membership active for an additional twelve-month term and Member is responsible for accruing dues. Member understands that annual Terms are necessary due to the Club’s long-term expense and commitment of maintaining a sufficient number of boats for Members’ use.

Member’s failure to pay all account charges within thirty (30) days of billing may result in the immediate cancellation of this Agreement and Member shall be subject to the collection of the total outstanding contractual amount. Member will not be entitled to a refund of any monies previously paid to the club. Nothing herein shall be construed as a waiver of Club’s right to seek recovery from Member for unpaid account charges.

LIABILITY & INSURANCE.

Club maintains insurance coverage for all Members. This policy provides coverage up to a limit of One Million Dollars ($1,000,000).

Member is responsible for the lesser of any insurance deductible or up to $3,000 for any damage to vessel(s) and persons caused by “Ordinary Negligence”*. Member is fully responsible for any damage to vessel(s) and persons caused by “Gross Negligence”*.

Any damage charges in excess of $100.00 shall be paid to Club within five (5) days of billing and Member’s failure to so pay will result in immediate termination of this Agreement, but shall in no way relieve Member of liability for said charges. Charges of less than $100.00 shall be added to Member’s next monthly dues statement.

* As required as an Operator in the Operator Terms and Conditions (under “Ordinary Negligence” and “Gross Negligence”)

NOTE (INSTALLMENT).

I understand that I have signed an Agreement. My failure to regularly attend and utilize Club facilities does not relieve me of my obligations, regardless of the circumstances, to pay the agreement in full.

Should I default, I agree to pay all costs of collection, including but not limited to collection agency fees of up to 50% of the unpaid balance, court costs and reasonable attorney fees, all of which may be incurred by the holder of this Note.

For VALUE RECEIVED, I promise to pay to the order of the Kirkland Sailing Club Club the total annual membership, payable in 12 consecutive installments  beginning first day each month thereafter until the full amount is paid and membership requirements are satisfied.

Monthly dues are due on the first of each month, Annual dues are due the first of the month of the annual anniversary, and biweekly dues are automatically billed every two weeks.

Should default be made in any monthly installments, the entire remaining sum due hereunder shall immediately be due and payable at the option of the owner of the Note and shall bear the interest at the rate of 18% per annum from date of default.

If any installment is more than ten days past due a late charge of 12% of the installment will be assessed.

I have read and so sign my acceptance of the above Membership Agreement as written and acknowledge that I have reviewed the Operator Terms & Conditions  and Membership Guidelines .
